Tenant letters in Italy: repairs, deposit and notice
Write to a landlord in Italy: report a defect, chase a repair, reclaim your deposito cauzionale and give six months’ notice by raccomandata. Italian examples.
Quick answer
Write to your landlord (locatore) to report a defect, chase a repair or ask for your security deposit (deposito cauzionale) back; these letters can go by email or post. Giving notice is different: to leave early, you need a withdrawal clause in the contract or serious reasons (gravi motivi), six months’ notice and a registered letter (lettera raccomandata). The deposit may not exceed three months’ rent and earns legal interest.
| Who it’s for | Tenants of private residential housing in Italy |
| Defects | Tell the landlord (art. 1577 c.c.); the landlord does all repairs except small upkeep |
| Deposit | At most three months’ rent, with legal interest paid yearly (art. 11 L. 392/1978) |
| Tenant’s notice | Six months, under a withdrawal clause or for serious reasons (gravi motivi) |
| Form of notice | Raccomandata A/R signed by hand, or PEC to the landlord’s PEC address |
| Common mistakes | Withholding rent, giving notice by email, no record of the handover |
This guide covers private residential tenancies (locazione abitativa) in Italy, including 4+4 (canone libero), 3+2 (canone concordato), transitional (transitorio) and student contracts. Take the landlord’s name and address from the contract, keep the rented home’s address separate and replace every placeholder. For an unpaid deposit, see payment demands in Italy; for internet and other contracts, see cancelling a contract in Italy.
Report a defect
The landlord must hand over the home in good repair and keep it fit for the agreed use (art. 1575 c.c.), doing all necessary repairs except small maintenance (piccola manutenzione), which is yours (art. 1576 c.c.): repairing wear from use, not from age or accident, as defined by the contract or local custom (art. 1609 c.c.). Tell the landlord when a repair is needed (art. 1577 c.c.), describing the problem, where and when it appeared and how it affects you, with photos. You may do urgent repairs yourself and be reimbursed if you notify the landlord at the same time. If there is danger, such as a smell of gas, call the emergency services first.

Chase a repair that has not been done
Refer to your first report, say what is still wrong and set a date. Do not stop paying or deduct an amount yourself: unpaid rent can lead to eviction (sfratto per morosità). A defect that appreciably reduces the home’s fitness for use lets you ask for a rent reduction or termination of the contract, unless you knew of it or could easily have spotted it (art. 1578 c.c.; art. 1581 c.c. for later defects). Most tenancy disputes reach court only after an attempt at mediation before a registered body (organismo di mediazione), each party assisted by a lawyer (art. 5 and art. 8 D.Lgs. 28/2010). A tenants’ union (sindacato inquilini) can advise you first.
Reclaim your deposit
At the handover, ask the landlord to sign a record (verbale di riconsegna) of the keys, meter readings and condition of the home. The deposit may not exceed three months’ rent and earns legal interest, payable to the tenant at the end of each year (art. 11 L. 392/1978). You must return the home as you received it, apart from normal wear and ageing (art. 1590 c.c.), so deductions should match amounts you actually owe: ask for an itemised list. The law sets no fixed repayment deadline. If your contract excludes interest or sets a higher deposit, get advice. A court payment order (decreto ingiuntivo) can be requested without prior mediation (art. 5, comma 6, D.Lgs. 28/2010).
Distinti saluti [Nome e cognome]
Give notice on your tenancy
Withdrawal (recesso) ends the contract early with six months’ notice if the contract allows it (art. 4 L. 392/1978) or, whatever the contract says, for serious reasons (gravi motivi) (art. 3, comma 6, L. 431/1998). The law does not define serious reasons: get advice and state yours in the letter. Otherwise, only the landlord’s agreement ends the contract early (art. 1372 c.c.). Notice runs from when it reaches the landlord (art. 1334 c.c.), and rent is due until the end date.
- 4+4 and 3+2: at the second expiry (the end of the four-year renewal of a 4+4, or of the two-year extension of a 3+2), either party can prevent renewal by raccomandata sent at least six months before (art. 2 L. 431/1998).
- Transitional (up to 18 months) and student contracts (six months to three years) follow ministerial models (D.M. 16 gennaio 2017); check the withdrawal clause. A student contract renews at its first expiry unless the tenant gives notice at least one and at most three months before.
The law names a registered letter (art. 4 L. 392/1978). Use a raccomandata con avviso di ricevimento (A/R), which returns a signed receipt, or a PEC (posta elettronica certificata, certified email) to the landlord’s PEC address, which the law treats like a postal notification (art. 48 D.Lgs. 82/2005); if the contract names raccomandata, use it. Email or an ordinary letter is hard to prove. Every tenant named in the contract should sign by hand.
An early end of a registered lease (risoluzione) must be reported to the Agenzia delle Entrate within 30 days with form RLI, paying a fixed registration tax of 67 euros unless every landlord chose the cedolare secca regime. The rules refer to the parties, not only the landlord, so agree who files and keep the receipt.

Post your letters and keep evidence
For repair and deposit letters, upload your final PDF or write the letter in MaisonMail, and add photos or documents as PDFs in the send flow. The recipient address determines the destination; available services, estimated delivery and the final price appear before payment. Keep a copy of every letter and attachment. Tracking shows that an item arrived, not what it contained. Send your notice by raccomandata A/R or PEC, as the law and your contract expect: a standard or tracked letter is not a raccomandata A/R. The mailing button below is for the repair and deposit letters only; it does not replace a raccomandata for your notice.

Frequently asked questions
How can a tenant leave a lease early in Italy?
You can withdraw (recesso) with six months’ notice if the contract has a withdrawal clause or, whatever the contract says, for serious reasons (gravi motivi) (art. 3, comma 6, L. 431/1998; art. 4 L. 392/1978). The law does not define serious reasons. Otherwise, the contract ends early only if the landlord agrees.
Can I give my landlord notice by email?
Do not rely on it. The law names a registered letter (lettera raccomandata) for the tenant’s withdrawal (art. 4 L. 392/1978). Sign the letter by hand and send it by raccomandata con avviso di ricevimento (A/R), or use a PEC (certified email) to the landlord’s PEC address; if the contract names raccomandata, use it.
When must the landlord return my deposit?
The law sets no fixed deadline. The deposit may not exceed three months’ rent and earns legal interest, payable to the tenant at the end of each year (art. 11 L. 392/1978). Ask for it in writing after returning the home and keys.
Who reports the end of the lease to the Agenzia delle Entrate?
An early end of a registered lease must be reported within 30 days with form RLI, paying a fixed registration tax of 67 euros unless every landlord chose the cedolare secca regime. The rules refer to the parties, not only the landlord, so agree who files and keep the receipt.
