Object to a German Bescheid: Widerspruch deadline and form
Object to a decision from a German Jobcenter, health insurer or other authority: one-month deadline, the four-day rule, accepted channels and German examples.
Quick answer
A Widerspruch challenges a written decision (Bescheid) from a German authority such as a Jobcenter, Agentur für Arbeit, health insurer (Krankenkasse) or pension insurer (Rentenversicherung). Start with the Rechtsbehelfsbelehrung, the notice on legal remedies at the end of the Bescheid: it names the remedy, the deadline and where to send it. The deadline is usually one month from notification, and a posted Bescheid counts as notified on the fourth day after posting. Your objection must arrive in time, as a signed letter or through an accepted electronic route. You can send the reasons later.
| Who it’s for | People challenging a written decision of a German authority, especially on social benefits |
| Deadline | Usually one month from notification; one year if the remedy notice is missing or wrong |
| Notification | A Bescheid sent by post counts as received on the fourth day after posting |
| Form | Signed letter, a declaration at the office or an accepted electronic route; not ordinary email |
| Reasons | Can follow later; the first letter must identify the decision and say that you object |
| Common mistakes | Phoning instead of objecting, counting from the date on the letter, writing to the wrong office |
This guide explains how to prepare a Widerspruch where that remedy is available, using social-benefit decisions as the main example. A complaint, a phone call or a request for an explanation does not replace a formal objection. The examples help you object in time; they do not decide which remedy is right for your case.
Check that Widerspruch is the right remedy
Read the Rechtsbehelfsbelehrung: it says which decision you can challenge, which office must receive your submission and whether the remedy is a Widerspruch, an Einspruch or a direct court claim (Klage). Tax decisions, including Kindergeld decisions from the Familienkasse, are challenged with an Einspruch. An objection to a court Mahnbescheid follows a separate procedure, and an appeal against a court judgment is not a Widerspruch at all. Some federal states have abolished the objection procedure for certain matters, so the notice may point straight to the administrative court. Keep the whole decision, including the remedy notice.
Work out the deadline
Under § 84 SGG, an objection to a social-law decision must generally be lodged within one month of notification, or three months if the decision was notified abroad. § 70 VwGO also sets one month where its objection procedure applies. A Bescheid sent by ordinary post counts as notified on the fourth day after posting, unless it arrived later (§ 37 SGB X, § 41 VwVfG). For example, a Bescheid posted on 2 March counts as notified on 6 March, and the deadline normally ends on 6 April; if the last day falls on a weekend or public holiday, it moves to the next working day. If the Rechtsbehelfsbelehrung is missing or wrong, the period is generally one year (§ 66 SGG, § 58 VwGO). Your objection must arrive by the deadline: posting it on the last day is not enough. Get advice promptly if the deadline may already have passed.
Choose an accepted channel
The law allows a written objection, certain electronic forms or a declaration that the office records for you (zur Niederschrift). Use the channel named in your decision, such as the authority’s official online service. An ordinary email or a general contact form is generally not enough. For a paper objection, sign it by hand and send it to the address in the remedy notice. If time is short, hand the letter in at the office and ask for a date stamp on your copy, or use the official online service, rather than relying on post. Keep proof of submission.
German example: objection without reasons
For a social-law objection, you do not have to give reasons with your first letter. This example identifies the decision and clearly states that you object, which secures the deadline; it does not guarantee that the objection is valid. Add your name, current address, the date, the correct office and the reference number (Aktenzeichen), and sign the letter or use an authenticated electronic route. Replace every placeholder. Do not limit the objection to part of the decision unless you intend to.
Add your reasons and check the reply
Follow up with the concrete errors, the correct facts and supporting documents. Keep to any deadline the office sets for this; announcing reasons later does not extend the original objection period. Do not assume the objection automatically stops a repayment demand, a benefit cut or enforcement: there are exceptions, and urgent protection may need a separate application. If you receive a Widerspruchsbescheid rejecting your objection, read its new remedy notice. The next step is usually a court claim within one month, not another letter; for benefit claimants, proceedings at the social court are generally free of court fees. Social welfare associations, such as the VdK or SoVD, and legal advice services can help.
Post your objection and keep evidence
Keep the original decision, the exact objection, attachments and proof of receipt. Use the office address from the remedy notice, not a general address found elsewhere. Only use MaisonMail print-and-post if the authority accepts such a letter and there is enough time for printing and delivery: a signature printed by a mailing service is not a handwritten signature, and the service cannot submit an authenticated electronic objection for you. Check available services and the price before payment. Tracking shows that an item arrived, not what it contained. The mailing button below does not file an electronic objection or a court claim.

Frequently asked questions
How long do I have to object to a Bescheid?
Usually one month from notification: § 84 SGG for social-law decisions and § 70 VwGO for other decisions where an objection procedure exists; under § 84 SGG it is three months if the decision was notified abroad. A Bescheid sent by ordinary post counts as notified on the fourth day after posting, unless it arrived later. Your objection must arrive before the deadline ends.
What if the Bescheid has no Rechtsbehelfsbelehrung?
If the notice on legal remedies (Rechtsbehelfsbelehrung) is missing or wrong, the one-month period does not start, and you can generally object within one year of notification (§ 66 SGG, § 58 VwGO). Do not rely on this without checking: object as early as you can.
Can I object by email?
An ordinary email is generally not enough. Accepted channels are a signed letter, a declaration recorded at the office (zur Niederschrift) or specific electronic routes, such as the authority’s official online service. Use the channel named in your Bescheid.
Does an objection mean I do not have to pay yet?
Not always. In social law, an objection generally suspends the decision, but there are important exceptions, including many Jobcenter decisions that cut or reclaim benefits. If you need to stop a repayment demand or a benefit cut urgently, ask the authority to suspend enforcement or apply to the social court.
