Notice of default (messa in mora)
A messa in mora (costituzione in mora) is a written demand that puts a debtor in default on an obligation already due. Think of it as the formal payment demand that starts legal consequences, one step beyond a friendly reminder (sollecito). In Italy, it needs no set wording and is unnecessary in some cases, such as when a sum payable at the creditor’s address has fallen due; legal interest runs from default, and once the demand reaches the debtor it interrupts the limitation period (prescrizione). It does not establish that the claim is valid.
